　功利主義は、一般的原理としては、対象とする集団を時間的、空間的に確定できないという欠陥をもつ。しかし、それは同時点集団内における、幸福の量が明確に異なる対立集団が存在する状況に適用される原理としては有用である。その一例は封建制社会の末期における市民革命の是非への適用である。社会契約の原理は、市民社会成立時に必要な初発的、基本的なルールが求められる問題状況において必要となり、また実際に適用される原理である。それは全員一致を必要とし、反対者には「離れる権利」を保障するものである。その上で、多数決原理は全員一致を必要としない程度の重要性の低い問題状況においてのみ適用されうる。

Utilitarianism has a defect that it, as a general principle, cannot decide the human group to be focused neither from the viewpoint of time nor space. But it is useful if it be applied to a human group which has conflicting sub groups with clearly different amount of happiness, an example of which is its application to the evaluation of civil revolution at the end of feudal age. On the other hand the principle of Social Contract becomes necessary and is actually applied to such an occasion as when the first and fundamental rules for starting a civil society are needed. It demands unanimous consent and must provide the "right to leave" to the minority opponents. Based on and within the framework of these first rules, the rule of majority is applied only to the occasion with less important issues which do not demand unanimous consent.
